To Shim Changmin:

You always wish to have a modest appearance. Although it can be said to be a postive aspect of you, but on the other hand, there are times when you show a complete opposite side, so there are often times when you worry about yourself... but recently, I've started to have the mindset of appreciating myself and to be proud of myself, so it can be considered a really lucky thing.

Although in the past, it was exactly as what everyone said: I used to live while looking inward and constantly stressing out, making it harder for myself... but in future, I want to have more faith in myself and live my life like that... Didn't I have the misguided thinking that I was born without a choice on who my parents would be? So, work harder!

Even though I said before: The old me faced many different choices, but the present and future me, will still have many choices that I have to face. In future, no matter what I encounter, no matter who I have to stand before, I want to do the right thing and make the correct choice like I have done so far. Also, as long as I can become a person who stands firm with the right choices I make, that would be good. Of course, I might feel tired because of these choices and I might encounter many difficult things... but if that is the price I have to pay in making the right choice, even if I have to accept punishment, I will break through all these difficulties and ultimately receive wisdom and knowledge.

I think this attitude I have towards life is something I learned from my parents. Although I still have to learn to face up to reality, but no matter how difficult it is, if I cannot make a right choice then I'll have to shake off those options decisively, and from that, become a wiser, more knowledgeable and confident me. In future, won't there be choices that will make me become like that? Haven't I become an artist now? To be an artist as an occupation... Although I've been an artist for a few years, even though there are still many things that I don't fully understand, but I still show my candid side when I appear in front of everyone. There's also a side of me that even I don't know about; aren't there times where I also have to show a side of myself that is not me?

To be honest, this is not something that I dreamed about when I was a child... Who I am now... I often have this thought... "If I'm not doing what I'm doing now, what else can I do? Would I have become a son that constantly causes his parents to worry?" The things that I am doing now may not make people feel exceptionally proud or seem fulfilling. However, don't I still pass each day happily, looking forward to a better tomorrow?

It allowed me to see a beautiful world that I didn't know about and awakened the person that I am now... Teacher Lee Soo Man... SM Family still holds the same gratitude in our hearts, so never change^^ If you are still the person that you are now, the heartfelt gratitude we have towards you will never change...

Now I'm also in my twenties... Compared to others who are of the same age, I had to start working a little earlier and I didn't get to experience the things that they went through... But isn't there a saying, "you gain something when you lose something", this phrase is not said without reason. I always do my utmost best to fulfil my responsibilities to try and carve an even better future for myself. I want to expand further, so let me continue to better myself.

When I think of that I will do everything passionately... even though there are many people in the world who look at me enviously... Instead of always trying to hide from these prying eyes, I think I should do things that are honest to what I really feel and to have a youth which is filled with passionate love when I date someone! Even though it's not an easy task and there might be failures... but I can experience the feelings and passion that belong to my age... I don't want to miss a thing. I think this is a way to make me work harder to become even more passionate... Even if I fail, I still think this way... Career and love... Like what I said before, I don't want to miss out on anything anymore... But, if I make a mistake when it comes to relationships, it will become even more dangerous...

In order to have better judgement, I will make decisive choices with a judgement that is as sharp as a blade. I will become a youth that is even more passionate and hardworking than others... I'll work hard to be even more passionate and rational...

TVXQ's U-Know Yunho is garnering attention for visiting the JangsungHyo Love Hospital in Jeolla Province during the afternoon of the 6th to give his greetings for the New Year.

[INFO]War For Seats For TVXQ's 3 Members' Charity Fanmeet

There's a "raging war for seats" going on for the 3 TVXQ members' charity fanmeeting, which will be held on 12 December.

TVXQ's Xiah Junsu, Hero Jaejoong and Micky Yoochun will be meeting their Korean fans through a charity fanmeet.

On 12 December, 5pm, they will meet the fans through the "Smile Again" charity fanmeet, to be held at Koryeo University Hwajung Gymnasium.

A staff member of the activity told Newsen on 8 December through a telephone interview that, "'Smile Again' will not be attended by other celebrities, and only the 3 members of TVXQ will participate." Also, "There will be donation boxes around the venue area. All proceeds collected during the fanmeeting will be donated in full to a children's charity."

Tickets for "Smile Again" went on sale on Yes24 on 8 December, 8pm. As tickets were very limited, there was a "war" amongst the fans for the entrance tickets.

[INFO] Xiah Junsu Village In Cambodia Is Created

A village that has adopted TVXQ's Xiah Junsu's name in Cambodia has been created titled 'Xiah Junsu Village'.

International organization AdraKore began building houses and improving living conditions for the poor in a village just an hour away from Phnom Penh.

This aid for the poor received a lot of help from TVXQ's Xiah Junsu and his fanclub who donated money to the organization last year. The fanclub members decided to give a thoughtful present by collecting donations and giving a fraction of it to AdraKorea.

AdraKorea began building houses for the poor who lived in unstable conditions and improved living environments to protect children from unexpected natural or man-made disasters and the organization was able to do this thanks to Xiah Junsu and his fanclub.

30 houses were reconstructed. Most of these houses were worn down and were made of banana or palm leaves. The ceilings and walls had been slowly disintegrating so whenever it rained, families were sure to get wet. However, these houses have been changed into warm, safe havens.

Jin Hana, who is currently helping out with the project in Cambodia, said, "When it rained at night, families had to move around to find a place where the rain or the wind couldn't get to, or they had to sleep leaning against the wall on an unstable bamboo floor. The children are now able to sleep safely and soundly."

Volunteer Shin Sung Eun said, "The people here don't know who TVXQ is, but they are very thankful that people far away in Korea have sent them donations of love," and "People here call this village the 'Xiah Junsu village.'"

Shin Won Seok, the secretary-general of Adra, stated, "We would like to thank Xiah Junsu and his fanclub for teaching us once more that giving helps people in need and makes the world a brighter place," and "Their love helped those in need in the global community."

Tohoshinki - Gold Artist Award

The five members of Tohoshinki finally stood together again, standing together on the same stage after the start of the problems.

At 7o'clock on the 26th, the three members who were in a turmoil with SM, along with the other two members approached the "Best Hits Festival 2009" stage together in Japan.

The fans of TVXQ's Xiah Junsu and Hwangbo have donated money for surgery fees and verbal remediation fees for hearing-impaired children and once again showed the warm love of fans.

The recent updates about TVXQ members will be released through E! NEWS KOREA.

On last July 31st, three TVXQ members namely Youngwoong Jaejoong, Micky Yoochun, and Xiah Junsu signed up a battle against SM to terminate their exclusive contract.

Currently the active members of TVXQ are only TVXQ U-Know Yunho and Choikang Changmin. Sometime ago, Jung Yunho had just finished his first acting debut as actor through MBC Drama “Heading To The Ground”, meanwhile Choikang Changmin is also reported to make his acting debut anytime soon.

In exception of those two members, all local activities of the rest members have been suspended thoroughly. Since the submission of application to “terminate TVXQ’s exclusive contract effect”, an information revealed that Youngwoong Jaejoong and Micky Yoochun had secretly tattoo-ed their chest together.

Summary of the Judgment of JaeChunSu's Petition

Summary of the Judgment of JaeChunSu's Petition for Preliminary Injunction to Void Exclusive Contract

Current stage of proceedings – Preliminary Stage, still needs to wait for actual trial

What was granted – temporary suspension of the exclusive contract + JaeChunSu can engage in independent activities + SM cannot compel JaeChunSu to participate in entertainment related activities (otherwise it has to pay $10,000,000 KRW per violation)

Why - “basic relationship of trust that is the foundation ...has already crumbled” (3B) and if the actual trial was prolonged, JaeChunSu would basically be receiving little or no income if they were not allowed to pursue independent activities

Why the rest of was not allowed – because possiblitiy that TVXQ may continue as a group + ratio of distribution of revenue are difficult to calculate (3C)

On the issue of 1,000,000,000 KRW – the reason why the Court needs JaeChunSu to pay a deposit (or a bond insurance) is because in the case where SM wins, the court has to ensure that they have enough money to compensate SM (it is a common practice to request the party with a weaker financial position to provide security)

VERY VERY Important points raised by the Court in its reasoning –

 On negotiating powers when accepting the contract – ONE SIDED
o 2B1 – The Court rejected SM’s claim that JaeChunSu has equal or superior negotiating powers in accepting the contract.
o 2B5 – “an extremely one-sided contract”

 On the 13 years contract period – EXCESSIVE
o 2B2 – the earliest date the contract ends is 13th January, 2017 excluding the conscription period. On the length of the contract, the court commented it is the longest amongst all provided examples (apart from Boa and Yoo Young Jin’s 15 years)

 On the amount of damages JaeChunSu has to pay if they terminate the contract – SLAVE CONTRACT
o 2B3 – court hints that it is unfair as SM can terminate the contract without itself paying damages
o 2B4 – court concludes that the provisions on damages goes more than the original intention (of compensating the injured party i.e SM)
and instead “absolutely blocks the Petitioners [Jaechunsu] from exiting the Contract for the sole purpose of maximizing the profits of the Respondent [SM].”
“ By doing so the provisions act as a device to enslave the Petitioners to the Respondent for the abovementioned contractual period of 13 or more years and the court finds it difficult to sanction such them as they are” [seems like the court cannot help but agrees with the lay term ‘slave contract]
o 2B5 – court believes that such contracts does nothing but to solidify the monopoly of large entertainment companies in Korea

 Conclusion –
o The contract is “contrary to the public morals and social policy, or otherwise void because it exceeds what is rational for the length of a contractual term”
o Unless SM modifies almost all of the important parts of the contract, including the contractual period and clause on damages in case of termination, this contract is likely to be void because it imposes on JaeChunsu an “unjust burden”

 Afternote –
o After the entering of the original contract (you can find the dates under 1C as listed in the table), there were 5 subsequent supplementary agreements. The last agreement is dated 6th February, 2009. [note from writer – this is the point of time where JaeChunSu claims they have not been receiving income therafter. It is unknown what amendment have been made which brought forward such claim]

Popular group Shinhwa member, Andy showed both his sympathy and affection towards his junior group TVXQ.

Andy who already released two independent solo albums recently has an interview with Asia Economic Daily. “I know what DBSK members have been experiencing these days must give them a little bit pain. As their friends only be able to see, it’s a shame. I wish the case will be ended through an amicable settlement which won’t hurt any parties.” he said.

Each member of Shinhwa has their own solo activities, but so far there’s no conflict arises as Andy said, “We’re trying hard to stick to each other rather than being greed off! You must respect even small things, so that you won’t lose the big one.”

Andy closed the interview by saying, “When later on Shinhwa could regroup again, we want to stand together with TVXQ on one stage. We don’t mind if people compares us, because we’re now stronger than we were before and we’re ready to get our victory, it’s not an impossible job to do. It’s not a shame to think a possibility of performing in showing a beautiful stage. Therefore, I really want to see TVXQ coming back again.”

TVXQ’s fanclub ‘Cassiopeia’ made a fan album to support TVXQ

Cassiopeia introduced a single album ‘Love Melody’ at an online music site on the 27th of October. This album was made by Cassiopeia who sang, composed and made the lyrics to show their love and power.

The title song ‘Love Melody’ is a ballad song with lyrics meaning such as ‘we will always be by your side’. As the album was introduced to public, the netizen (people on the computer) said ‘TVXQ’s fanclubs are just so amazing’ ‘ A amateur showing this much skill is terrific!’..etc with surprised responses.
