[NEWS] 100707 Musical "Goong" To Show Overseas Starting January Next Year

Official poster for musical "Goong" [Group 8]

The musical adaptation of hit TV series "Goong" will show overseas next year, according to the musical's producer Group 8 on Wednesday.

Park Rae-hyun, a PR official from Group 8 told 10Asia over the phone that producers will take the show to countries outside of Asia, starting with Japan, in January 2010.

He added that the company has yet to decide on the official dates and locations for its overseas run -- details for its showing throughout South Korea will be set first.

In Seoul, the musical will run at the National Museum of Korea from September 8 to October 24 and continue on into other provinces in the country until the end of the year.

U-Know Yunho, Kim Dong-ho and RUN will play the lead crown prince role of Lee Shin and actresses Gwak Sun-young and Shin Eui-jung will take over the role of the tomboyish Chae-kyeong.

"Goong," originally based on the best selling comic series of the same name, is about an average high-school girl marrying a royal prince in 21st century Korea, which is in fiction a monarchical country.

It was adapted for the small screen in 2006 and was a huge hit in the country recording viewership ratings in the high 30 percent mark and turning the two leads, Yoon Eun-hye and Joo Ji-hoon, into household names.

The drama was sold to 23 countries including China, Japan, Saudi Arabia, Taiwan and the United States, creating a Hallyu craze among the fans, particularly in Asia.

[NEWS] 091224 Japanese Fans to Raise a Whopping Five Million Yen for Newspaper Ad

TVXQ/DBSK supporters in the motherland and overseas have been riveted by the SME lawsuit for the past few months, and it looks like a certain group of international fans is really stepping up their game.

Five Balloons, a group of Japanese TVXQ supporters, recently created the TVXQ Smile Project, in which members donated money to put an advertisement in a daily Korean newspaper. Its monetary goal for Christmas? A whopping five million yen, which is approximately 64,400,000 won, $54,700 USD, or the price of a pretty nice sports car. [ omitted ]

The ad is expected to include the words 'TVXQ Smile Project,' a message about TVXQ's entity as a group only complete with five members, and a promise to forever love TVXQ and wait for them to sincerely smile.

As of yesterday, over four hundred participants collectively donated 1,764,000 yen (approx 22,700,000 won or $19,400 USD). Since this doesn't meet the initial December 25 goal, the members plan to extend the period of donation collections and purchase the ad in mid-January.

[NEWS] Interview with TVXQ's Lawyer Lim Sang Hyuk

-Did you know who TVXQ was?

"(laugh) This shouldn't be printed... I didn't know their faces. Before they came, I kept playing their music videos and putting pictures of their faces on my computer screen so that I could memorize their names and faces. I kept getting mixed up between Choikang Changmin and YoungWoong Jaejoong but luckily(?) Choikang Changmin didn't come here."

Meet Lawyer Lim Sang Hyuk who aided three members of TVXQ, YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu, when they submitted their exclusive contract suspension request against SM Entertainment. On November 25th, this is how the interview began with him as he waved his hand and said, "Don't ask me about TVXQ."

On October 27th, the Seoul District Courts partially accepted the request submitted by the three members. The Courts stated, "SM violated the economic freedom and basic rights of the members of TVXQ through their superior position. There is a high chance that the entire, or parts of the contract will be suspended fully." In words it was 'partial acceptance', and in reality, it signified the loss of the trial of the nation's biggest entertainment agency, SM.

What surprised the entertainment industry more than the Courts' verdict was the fact that the 'provisional disposition' method Lawyer Lim had used had actually worked. A provisional disposition is usually submitted when it is too late to submit a formal trial. A good example would be when the family of the deceased former President Park Jung Hui submitted a a press ban provisional disposition a couple days before the publication of the Glossary of Japanophiles.

-Why did you choose to submit a provisional disposition?

"In the case of celebrity contract disputes, there has never been a single case where the dispute goes to the Supreme Court in the past sixty years. For a formal trial to go to the Supreme Court, it would take 2~3 years but during this period, that celebrity cannot perform in any activities. Everyone starts a lawsuit and ends up giving up halfway through. Had TVXQ gone through with a formal trial, it would have been the end of their career."

Lawyer Lim stated that Sejong chose to submit a provisional disposition, people in the legal circles stated that, 'Sejong has made a mistake.' For a provisional disposition to be accepted, it must fit two criteria. 1. The contract should be nullified. 2. This is a problem so urgent that a provisional disposition is needed before the formal trial. Till now, all of the celebrity contract disputes have been ruled as 'not urgent'.

"We argued that this was a problem that needed to be dealt with immediately. In the case of idol stars like TVXQ, their lifespan is short so we stated that if we were to begin with the lawsuit that lasted 2~3 years, their celebrity career would be over by then. Therefore, the Courts accepted our claim."

Law Lim stated that not even he thought of a provisional disposition at first. "When we first discussed this, we told them 'We will be able to get this contract nullified. However, you won't be able to perform for a while.' This is probably why the two other members did not participate. After we told them that, when we were going through the legal process, that was when the idea came to submit a provisional disposition."

-How can SM retaliate?

"There are many ways. They can submit an appeal or a formal objection, or they can submit an Order of Filing a Lawsuit request which would tell us to, 'hurry up and start the formal trial.' They can also file a lawsuit on the grounds that they believe that the contract is valid. However, they have not done anything yet. We were able to get what we wanted through the provisional disposition. We were able to grant the members freedom to pursue any activity they wanted and stopped the contract. Of course, if the members were to be compensated for their income, then we would have to fight it out in a formal trial. But we are in no hurry."

-So many celebrities will begin using this provisional disposition method, right?

"We've given them a new method of commencing an exclusive contract suspension lawsuit."

Entertainment agencies can do nothing but be alert. Now the road is open that if the contract is deemed unlawful, a verdict can be laid down quickly by the Courts through a provisional disposition. "TVXQ has given their juniors a very big fight. Now, celebrities are able to keep their contracts or terminate them, they've been given another option."

The problem of unlawful celebrity contracts seems to be a long-term disease. It was put in the spotlight after the death of Jang Ja Yeon but then the situation calmed down once more.

-What is the reason that unlawful contracts occur frequently?

"It's because the barriers to entry are extremely high. It has come to a state where, without a large entertainment agency, it is impossible to debut. The singer doesn't get to question the content of the contract, all they can decide is 'should I sign it or not?'. Some of the clauses in contracts are very vague."

'SM will be in charge of all television appearances and all domestic and overseas activities.' This is what is said in the contract between SM and TVXQ. This controversial phrase is bound to be a cause of dispute. An issue that was including in this dispute was whether or not the three members' investment in a cosmetic company was an infringement on the contract. SM stated that it was indeed an infringement since the members could receive offers for commercials. The three members' side retaliated by saying, "So they are saying that the members must ask for permission even when buying stocks from Samsung Electronics. To say that the members must receive permission before doing anything, that is what a slave contract is."

-Why have even big stars like TVXQ endure with these contracts?

"The entertainment management industry is distinctively divided into Kpop, and non-Kpop. In the Kpop market, three major agencies are monopolizing the market. They train people, create albums, etc; they basically contain all the infrastructure necessary. It is hard for a new company to enter this market. It's a monopoly. Even TVXQ is on the second tier in this industry."

-What about other fields?

"The non-Kpop industry is a competitive market. As long as you have great connections and good people, you can succeed if you decided to set up an agency. This means that the barriers to entry are relatively low. The power of the agencies isn't as big."

For actors, they have an 'escalating clause' in their contracts. This means that even rookies can change clauses in their contracts if they become popular.

-Is there a way to stop this from happening again?

"The celebrities can go on strike."

The celebrities go on strike? It's a sight that is difficult to imagine. However, he was serious. If they couldn't go on strike, the labor union could work as the profits distributor, and if even this did not work, then the unfair system could not be fixed.

"In America, celebrities have labor unions, guilds. The production teams and the actors are compromising a labor collective agreement. Even when a rookie actor signs on to a production company, they have to get the signature of the labor union. It is hard for an unlawful contract to exist in such an environment."

-Will a celebrity strike really be possible?

"Haven't you heard about the American actors who went on strike?"

Last December, the Screen Actors Guild got to the brink of a strike. This was because their labor collective agreement negotiations with the Alliance of Motion Picture and Television Producers was broke down. In June, the labor collective agreement negotiations, which dragged for almost a year, was finalized and the long dispute was finally stitched up.

-Will this be possible in Korea?

"It will if Bae Young Jun and Jang Dong Geon move." He stated that a 'passionate person' was more important than a 'structured individual'. He held the Korean Radio & TV Writers Association as an example.

"In the contract script writers sign with broadcasting companies, it is so equal that it is hard to differentiate between the company and the writer. This is because Writer Kim Soo Hyun took the lead." Writer Kim solved the copyright issues with broadcasting companies by advocating a strike during 1987~1995."

-When it isn't their business, will Korea's top stars take a stance?

"In America, top stars such as Richard Gere and U2 took a stance. In our nation, no one is willing to step up to the plate. Even though the verdict of the Court has been released, no famous celebrity dares to even make any implications about the TVXQ dispute. If this was America, all the top stars would have said something by now."

Then we asked the question that we most wanted to ask. A terse answer was given.

-Doesn't the statement of the agency have a certain amount of reason too?

"It has been the theory of entertainment agencies for tens of years that 'overextended contracts are inevitable because of dangers in investments.' However, the Courts have never recognized this theory."

The verdict of the Courts is always clear and concise. Even in this case, the Courts staged, "It cannot be said that dangers in investments can justify overextended contracts and excessive compensation. There are always dangers when it comes to investing in any market and that is a part that can be compensated."

A change has already begun. JYP Entertainment put in place a new basis for contracts last month. The Fair Trade Committee ruled that the contract JYP made was a 'fair contract' that fit the criteria of the committee's basis for contracts. A law to reform the way the entertainment industry is run is also to be the center of discussion in the National Assembly.

"This method that is currently being used must stop. We cannot let this industry, that oppress people and squeezes them dry for profit, continue."

Lawyer Lim is counted as the 'second generation' celebrity specialized lawyer. This means that he does not consult and legally fight for an individual celebrity, but the celebrity-culture industry as a whole. Those such as Lawyers Choi Jung Hwan and Hong Seung Gi, who have dealt with countless celebrity-related lawsuits, are called first generation lawyer. It may be because major law firms Sejong and TaePyungYang have steeped up to take on the issue, but it can be seem that this dispute between an entertainment agency and a celebrity has moved to a second generation level. One wonders if the entertainment industry will change as much as this dispute has evolved.

"This is a chance of a lifetime. Thanks to TVXQ's name sake, this issue has been publicized and a new 'weapon' of the provisional disposition has been given to celebrities."

[NEWS] PD Park SungSoo, revealed that he dont know Yunho

During the press conference for the upcoming drama \“Heading to the Ground”, the PD, Park SungSoo, revealed that he didn’t know the Yunho cast for the main role was the Yunho from the popular idol group TVXQ / DBSK / Tohoshinki.

The reason for this is because Yunho signed up for the role under his real name of Jung YunHo. The PD also mentioned that when he realized it was the actual Yunho from TVXQ, he was surprised at how humble and nice he was. Yunho didn’t act pretentious or like a big shot from the biggest boy band in Asia. Yunho broke the stereotype that the PD had for a typical idol star.

The PD said when he first met Yunho, Yunho told him about his harsh experiences as an early teen. When Yunho went from small town Gwang-Ju (southern portion of South Korea) to Seoul, Yunho grew up on the streets, not having a home and having to do menial jobs to get by. Because of this, the PD thought that he really knows what hardship is like and he can use those experiences for his role and make this drama come to life.

It’s good to see that someone like Yunho, who had nothing and grew up on the streets could one day become a big star in Asia.

[NEWS]Interview With Crebeau President Kang Seok Won

The cosmetic company that is being shown by SM Entertainment as the crux of the TVXQ dispute. To find out what exactly the relationship is between TVXQ and the cosmetic company, we met with Kang Seok Won, President of Crebeau, for an interview. President Kang Seok Won carefully picked his words and said, "More than 10 years of hard work to build this company are being rattled because of TVXQ's small investment."

Question&Answer

▲What is the relationship between Crebeau and the three members of TVXQ?
=Crebeau was created over 12 years ago. It has been over ten years since we began using sheep placenta as a main ingredient in the cosmetics. This can be easily verified in our homepage or on our certificate of authentication. We have over 100 stores in Korea alone. We are also a company that has spread to China and Japan. TVXQ's Xiah Junsu, Micky Yoochun and YoungWoong Jaejoong made only small investments in our company.

▲What kind of company is the Beijing Representation Corporation that sued the three members of TVXQ?
=The Beijing Representation Corporation is the company who is in charge of all the Crebeau stores in the Shanghai region in China. We currently have three chain stores open in Shanghai as of now. We met for the first time at the Company Presentation that was held in China in January of this year and signed a contract together. This company opened these three stores in July and officially began their business. As soon as they opened, complications arose. (President Kang showed Sports Seoul the contract between Crebeau and Beijing Representation Corporation) Beijing Representation Corporation were not adhering to the clauses in the contract and were using TVXQ to advertise their products. They irrationally held advertising events, and when we intercepted their actions, they decided to file the lawsuit.

▲If the three members of TVXQ only hold small investments, why where they sued?
=The three members attended the Investment Presentation we held in Shanghai in January. After listening to the Investment Presentation, the three completed their investments in March/April. The Beijing Representation Corporation interpreted 'The TVXQ Three members have invested' as 'The TVXQ Three members are now ambassador's to Crebeau.' Therefore, the company tried to use TVXQ to advertise products but as soon as we heard of this and intercepted their actions, they retaliated. (Holding the contract)In the contract, not even the 'T' of TVXQ is mentioned. The three members of TVXQ represent SM Entertainment, not Crebeau. The side that violated the contract is in fact Beijing Representation Corporation, not the three members.

▲Do you have proof that Beijing Representation Corporation violated the contract?
=On October 2nd, when the TVXQ Shanghai concert was coming up, they sold cosmetics tied with tickets for the concert. We have even collected evidence of this. They opened a store that did not follow our standards, and illegally sold cosmetics at discounted prices near the concert location. These are all violations of the contract. The main office located in Korea told Beijing Representation Corporation to ask for all of the cosmetics sold along with tickets to be returned so that the company's image would not be tarnished. 70 million Won worth of damages were incurred but the main office compensated for all of these losses.

▲When you say a 'small investment' by the three members of TVXQ. How small is their investment?
=The three members invested less than 100 million Won each in the Chinese branch of our company. Crebeau itself invested more than 3 billion Won for the Chinese expansion. The three members' investments combined are only worth around 300 million Won. It is only around 1/10 of all of the investments. Xiah Junsu's father also showed interest in investing. We gave him the right a chain store outside of Seoul. All the investment money related to TVXQ does not amount to much.

▲How are you planning to deal with Beijing Representation Corporation?
=We are going through the appropriate steps with a lawyer from China. They are at an advantage as this is a case that will be dealt with using the laws of China. That is why Beijing Representation Corporation did not sue the Chinese office of Crebeau either. If there was a problem with the company as a whole, why did they just sue the Korean main office? This is their blind spot. I believe that the truth will always win.

▲SM Entertainment is blaming the cosmetic company for the TVXQ dispute.
=We find it quite absurd that we are being blamed for the dispute between TVXQ and SM Entertainment. Many people were witness to TVXQ's Xiah Junsu receiving permission from SM to invest in the company. All the procedures we had to go through were legally correct and there were no problems. SM Entertainment blamed us only after the dispute occurred between the agency and members of TVXQ. Because of SM, our work has been disrupted and our image has been tarnished.

▲How do you plan on solving the issue regarding SM?
=This is a problem that has nothing to do with the three members of TVXQ. It is a problem between two companies. SM Entertainment used Crebeau as a scapegoat and tarnished our image to put the blame of the TVXQ dispute on us. The Chinese and Japanese plans we have been making have been rattled because of SM's claims. The main office of Crebeau in Korea, as well as our offices in China and Japan are planning to get together and file a large-scale lawsuit against SM. We will receive an appropriate apology for our tarnished image and disrupted work.

[NEWS] 091106 Unfair Contract Dispute, SM has Changed its Stand?

SM Entertainment CEO's Kim Young Min, who is involved in the ‘unfair contract’ dispute with his artistes, has recently announced a new contract policy, and that it will be put into action once it gets approved by the related authorities.

SM Entertainment Representative, Kim Young Min, who attended the press conference which was held on the 2nd of November 2009 at 63 Tower, has expressed, “We would collect all comments from music and entertainment industries, related government departments, cultural and tourism board, fair trade departments, educational circles and legislative bodies, based on the law to adjudicate a new contract policy. After the approval from the respective authorities, we would then put it into action. Then follow it (new contract policy) enthusiastically.”

Kim agreed, “If we are able to come out with a new exclusive contract policy based on the law, SM would like to re-contract with all current artistes based on it.”

Kim also expressed, “Under the new exclusive contract, the moment it’s signed it would be protected till the contract ended, if not the current situation would repeat over and over again in the future.”

“In order to prove that what have just I said is nothing but the truth, we would first like to take the advice from the impartial committee,” he said.

But, everyone was not able to fully believe this announcement by SM Entertainment. Professor Lee from Korea Art University stated, “If SM do not wish to have what they have just said to turned into nothing, then they should assure them.” He continued, “Based on what SM have said, they do not wish to fully take on the advice from the impartial committee, but to forcefully come out with a new contract policy, which was questionable (their announcement).” Professor Lee ended, “If SM was really sincere about this, they should work on the new contract based on the advice and not vice versa, and then to get it approved by the representative authorities.”

[NEWS] Yunho’s HTTG Shooting Completed

Tohoshinki’s YUNHO (Jung Yunho) has finished the last shooting for the Wed & Thurs drama “Heading To The Ground” (MBC).

A related person said on Nov 3 “The last shooting was a soccer scene. It was piercingly cold so that it was much difficult than previously shootings. The staffs wore thick jackets, but all the actors playing soccer (including Jung Yunho) only wore soccer wear (short pants), so it should have been difficult.”

This day, Jung Yunho shot a scene being accidentally toppled by another player, committing many fouls. But he did not forget to smile till the end, and have done his best. All were very impressed. The other actors was influenced by Yunho, and pumped up thinking “Let’s take care of ourselves not to be injured, and hang on till the end”.

[NEWS] CreaBeau speaks out on TVXQ Issue

It seems we finally have word from the company that seems to be tangled in this mess.

When the TVXQ / DBSK / Tohoshinki controversy first began, the three members and their lawyers clearly stated that the three members’ investments in the CreBeau cosmetics line did not have any relevance to the court case. The core of the controversy was the legal issues of the slave contract. In SM Entertainment's opening statement, they stated that the lawsuit was because of the cosmetics issue.

To clear up the confusion, Kang Suk Won, the President of the Korean branch of CreBeau (Wishop Plus) was interviewed. Kang has already sued SME’s CEO Kim Young Min for slander to the Seoul Central Court on October 4th, 2009.

Kang said, “Although this case is obviously to fight the unfair profit splits and the conflict between the members and SME, SME is trying to push the blame onto CreBeau.”

Kang went on to reveal that the three members have only invested approximately 70,000 dollars, 60,000 dollars, and 40,000 dollars respectively. This amount, he said, was not enough to earn the three members rights to ownership of the business, let alone a big part of the profit.

Kang said, “In May 2009, some SME representatives visited the original branch of CreBeau Cosmetics in China twice. They determined that the members were not going against contract terms in any way, and now SME is distorting the true reason behind the case and putting out ridiculous claims... SME said that the whole lawsuit was due to the members’ wanting to continue a business that went against contract terms. This has no credibility in that SME has already approved of the investments previously. The members wouldn’t risk all the things that they gained as TVXQ by creating a conflict with their company over insignificant investments. It was a private investment, and the three have no ownership over the business in any way. They’re merely investors, nothing less, nothing more. What does this have to do with the lawsuit, and why is SME attempting to connect the two together?”

Kang went on to say that SME’s actions have brought about significant harm to the business not only in Korea, but all over Asia, including China, Japan, Hong Kong, Taiwan, Vietnam, and even the United States. For the employees and CEOs all over the world, CreBeau is their sole income. SME should have considered the impact its blames would bring to the business and the people involved in it.

“If SME’s company and its profits are so important that they are willing to harm others for it, then SME should recognize that it is the same for others.” Kang went on to say that “If SME does not stop distorting the truth and doesn’t apologize for the harms it brought upon CreBeau, I will not hesitate to reveal the details of SME’s absurd act to the public and to the court.”

Cassiopeia releases an official statement regarding SME’s allegations

Members of the Korean Cassiopeia, TVXQ/DBSK's official fanclub, have released their official statement regarding SM Entertainment's press conference regarding legal dispute involving DBSK which took place yesterday. Here is the translated version of their statement:

We 800,000 Cassiopeians would like to announce our official view in this statement. With accusations and allegations flying everywhere, we announce this in order to show the fanclub's official standing on this matter. This statement is made by union of numerous DBSK fan cafes and we present this in the name of Cassiopeia.

First of all, we would like to say that, as fans of DBSK, we support DBSK and will not do anything to betray their trust in us. We will not trust anything besides words that come out of the DBSK members' mouths, and we ask SME to stop actions that are intended to confuse and divide the fans.

We Cassiopeians are very disappointed at SME for holding press conference and releasing signed documents in the name of Yunho and Changmin. As the management company of DBSK, SME must not forget their job and must stop their actions intended to defame the members of DBSK and break the group apart. Also, according the the court ruling made on the 27th, SME must not make deals with third parties in the name of the three members and cannot interfere with individual works or those members. Please keep the court's order.

To everyone who is reading this statement; please remember: the members did not take legal actions because of the issues regarding the cosmetics business. They started this lawsuit because of illegal contract length of 13 years. We fans do not understand why SME is silent about the issue of the contract length and is trying to focus everyone's attention on the cosmetics fiasco. The goal of this lawsuit was to nullify or edit contract between SME and the three members, and we believe that they did not intend to end DBSK or move onto another management company. Also, we would like to address to reporters who sensationalize and create rumours related to this press conference. Please be careful with your sources.

We would like to ask SME one more time to not make the three members' reputation and rights suffer with claims that have never been proven, and we would like to ask the citizens of Korea to stop creating rumours and defame DBSK. We would like to show our condolences toward this controversy.

As Cassiopeia, the fans of DBSK, we will keep our attention focused to the future actions of DBSK and SME. We will continue to side with DBSK. DBSK and the fans never doubt.

CEO of SME calls the legal actions a “fraud”

After everything that has happened tonight, many are waiting for the official words from SM Entertainment, and allkpop is first to bring you the statements from a press conference that just took place!

The entertainment company held a press conference today and told their side of the story regarding their legal dispute with three members of TVXQ/DBSK. In addition to a statement by Yunho and Changmin, the two members who did not take legal actions against SME, and statements by their fathers, SME's own representatives spoke up as well; Mr. Kim Young Min, the CEO of the company, stated the following.

Back when we first advanced to Japanese market with S.E.S., major entertainment companies in Japan normally asked for contracts in length from 5 to 7 years. As long as the entertainer stayed with the company for the stated amount of time, the company would not cease investment into the entertainer. When we first planned for BoA to work in Japan, we set the length of the contract at 10 years to allow for long-term investment and a partnership with a major Japanese entertainment company. This resulted in SME working with AVEX, the largest entertainment company in Japan. BoA's great success in Japan was a product of such planning.

When we first planned for DBSK, we wanted to make them the number one artist in Asia. Five members and their parents shared such vision and agreed to add 3 years to initial 10 year contract. The members and their parents agreed to the contract because they found the vision as the number one artist in Asia, constant support from SM, plans to go abroad and continuous investment into the group very appealing. Everyone thoroughly reviewed the contract and agreed to all clauses. To keep the promise of advancement into Japan, SME invested over $4 mil into DBSK despite poor financial condition that the company was in. After 5 years in Japan, we can finally say that we are successful. It is unfair to focus merely on the number 13 without any background knowledge of how the contract was made and the goals and visions shared between SME and DBSK.

Kim Young Min then revealed some startling events that had occurred earlier this year.

On January 6, 2009, the three members told SM that they were going to China for a vacation; but in fact, they attended a meeting with the beauty product company's Chinese subsidiary to talk about investment into the company. We only realized of the deal after photos of them promoting the company surfaced online. We then learned that the three members are board members of the Chinese subsidiary and that they even carry business cards of the company with their name and position engraved.

The three members demanded an increase in their share in profit and we accepted their demands. In April, we had a dinner party after our concert in China. The three members told members of other groups about how much they trusted in SM. Shortly after in May, a Japanese fan asked AVEX's customer service department regarding an event by the beauty product company which claimed that the winner would have dinner with DBSK. SME feared that losses resulting from matters related to the beauty product business would be impossible to recover from. We wanted to review the members' contracts with the beauty product company to protect the members from potential dangers but they refused to share the contract with SME and did not take any actions to relieve SME from our concerns regarding their investment into that company. In June, a major beauty product company contacted us and said that they wanted to use DBSK in their commercials but the three members refused due to their own interest in beauty product business. Shortly after they took legal actions against SME.

The truth face of their action is a fraud. A fraud which fooled the entire nation with words such as "human rights" and "slavery".

Regarding the recent court ruling; three members are now free to pursue personal projects, however all DBSK-related work must be done through SME. Yunho and Changmin intend to promote DBSK in Korea next spring, and we feel that it should be planned at least six months in advance. SME asks the three members to respond to this by November 12th.

With allegations against them coming from the two members, their parents and SME, the other three members are sure to defend themselves from these claims.

Yunho and Changmin’s fathers express strong disapproval of other members

Many readers and TVXQ/DBSK fans were shocked when members Yunho and Changmin revealed their support for SM Entertainment just an hour ago. But it looks like things aren't ending there - two other very important men involved with this controversy have decided to express their thoughts.

The fathers of Yunho and Changmin, the two TVXQ members who were not involved with the controversial lawsuit earlier this year, spoke up in support of their sons and SME while condemning other three members and their parents. They claim that the dispute has more to do with the trouble that has arisen from the beauty product business rather than mere contractual matters.

Mr. Chung, the father of Yunho, stated:

The two members who did not involve themselves in this legal dispute are the real victims here. They suffered from financial loss, psychological suffering and most importantly they lost their reputation. Who is to compensate them for their losses? I intend to ask the other three members this: Whatever the reason, why do you intend to cause such great controversy and drive DBSK, an international brand name, into a break-up? Do you care at all about the other two members and their suffering?

The beauty product business wasn't something that was supervised by SME. On top of that, the beauty product company itself wasn't very trustworthy. When it was started, I felt that DBSK's reputation could potentially suffer from involvement with that company and advised my son of the issue. He shared my concerns as well, and that is why he did not involve himself in the business. SME later asked the three members to withdraw from the business but their parents resisted unreasonably. Mr. Shim (Changmin's father) and I tried to convince them as well but they simply refused to change their minds. I later learned that the three members took up legal actions against SME without consulting me nor Mr. Shim. DBSK is not owned by those three members only. They ignored not only the controversy that would rise but also the rights of other two members.

Mr. Shim, father of Changmin, stated:

Simply put, the other three members took legal actions against SM because of the beauty product business matter and other reasons which involve their financial gains. What they claim as their reasons, reasons such as unfair contract and unclear profit division are merely excuses to hide the true reason behind their actions. After the three members started the beauty product business, one of the parents called me and told me shenanigans like "This business can be worth millions or even billions in the future. When we tell the media that DBSK has started a business, share price of our company will hit the roof - we will tell you in advance so you can profit from the information."

Three members claim that the contract is unfair and calculations are unclear, but my son and I have read over the contract with SM clearly and agreed to all clauses, from the very first contract through all five revisions that have been made. For every income my son has received I reviewed all of the the numbers. I feel sorry for the three members and their parents as they must know of the truth but they continue to make false claims."

Looks like this is really heating up... make sure to stay tuned as allkpop continues breaking developments on this controversy to you first. Also check out the quintet's #1 international fan forum, OneTVXQ Forums

Changmin and Yunho support SM Entertainment!

TVXQ
Yunho and Changmin of DBSK/TVXQ stated that they are on SM Entertainment's side on the legal dispute between the company and other three members. They said that they trust SM and will be with them in the future. They also gave a deadline to other members, saying that DBSK will come back to promote in Korea next spring, so the other three members must make a decision before the 12th of this month.

The two members' thoughts were delivered through a document complied by them, which stated:

Us five members of DBSK signed the same contract with same clauses and for the past five years we have worked together under same conditions with utmost trust in the company, each other and our dreams. We intend to share our dream and future with the company and keep the promises we made in the contract. DBSK was made by SM and we intend to work as DBSK with SM.

No other company can create DBSK, as only SM can provide the best production and management team available. The three members must know better than anyone else that SM is the one who knows DBSK the best and made DBSK the best. We intend to keep trust and promise and hence we intend on staying with SM. DBSK's grand future will be with SM. I believe that our Korean promotion, planned for next spring, should be prepared at least six months in advance before our future as one DBSK becomes unclear. If other three members truly want to stay as one DBSK, they must make a decision before it is too late.

They also commented on the beauty product controversy which sparked this legal dispute:

The beauty product business changed everything," they stated, "We are not familiar with the matters but we believe that a legitimate company that seeks to do business with DBSK must consult with SM first. It is common sense. We did not get involved as getting involved with a company that sought to do business without SM would have meant that trouble was ahead.

We did not want the reputation and pride of DBSK, earned by our hard work, to get ruined by a beauty product company that did not work in a legally respectable manner. We are not aware of the contract between that company and the three members, nor do we know what those members were told or how much they have earned through their deal. What we do know is that the fact that DBSK, forged together for 5 years by all of our dreams, have fallen into the current state because of an unethical company is simply unacceptable.

DBSK crumbling away like this, this is all so unbelievable. It is sad to see that this was all caused by some beauty product company, and we hope that the three members would come back to the days when we were all working hard for our dreams.
